Terms & Conditions

1. Acceptance of Terms

These Terms & Conditions (“Terms”) govern your access to and use of the SurfPan judging application and related services (collectively, the “Service”). The Service is operated by SurfPan (“we”, “us”, “our”).

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and all policies referenced herein, including our Privacy Policy. If you do not agree with these Terms, you must not use the Service.

2. Who May Use the Service

You may use the Service only if you:

  • are at least the minimum age required by your local law to enter into a binding contract, or
  • have obtained verifiable consent from a parent or legal guardian, and
  • are not barred from using the Service under any applicable laws.

Organizers are responsible for ensuring that all judges, participants, and staff using the Service meet the relevant age, eligibility, and legal requirements.

3. Description of the Service

SurfPan is a competition judging platform designed to help organizers manage heats, judges, scoring, and results. The Service may include:

  • Creation and management of competitions, divisions, heats and schedules.
  • Judge accounts and judging interfaces for scoring competitors.
  • Live and historical scoring views, rankings, and result summaries.
  • Organizer dashboards, configuration options and reporting tools.
  • Integrations with third-party services such as payment gateways or analytics.

We may update, improve, or modify features of the Service at any time, with or without prior notice, as long as such changes do not materially reduce the core functionality you have already paid for during an active subscription term (where applicable).

4. Accounts and Security

4.1 Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep this information up to date.

4.2 Account Responsibility

You are responsible for all activities that occur under your account, whether performed by you or any third party. You must maintain the confidentiality of your login credentials and immediately notify us of any unauthorized use or security breach.

4.3 Organizer Accounts

“Organizers” are users who create and manage competitions. Organizer accounts may have additional permissions and responsibilities, including:

  • Inviting and managing judges and staff.
  • Configuring competition formats, elimination systems, divisions and heat structures.
  • Managing participant data and communications.
  • Managing payment settings, if applicable.

Organizers are solely responsible for the rules of their competitions, fairness of judging, and compliance with national federation, association or league regulations.

5. Judges, Scoring and Results

5.1 Role of Judges

Judges are users authorized by an Organizer to score performances using the Service. Organizers are responsible for the selection, training and oversight of their judges.

5.2 Data Entry

Judges and Organizers enter scores, start/stop times, heat statuses and related data into the Service. The accuracy of this data depends on those users. We do not independently verify any data entered into the system and are not responsible for errors caused by:

  • Incorrect or incomplete data entry;
  • Misconfigured heat formats or competition settings;
  • Device issues, connectivity problems or delays;
  • Misinterpretation of competition rules by Organizers or judges.

5.3 Rankings and Leaderboards

The Service may automatically calculate rankings, heat winners, and other results based on configured rules and scores provided by judges. These outputs are provided “as-is” and may not reflect official competition results. The Organizer retains final authority over official standings, results, and awards.

5.4 No Guarantee of Outcomes

We do not guarantee that use of the Service will lead to any particular competition outcome or ranking. We are not responsible for disputes among participants, judges, Organizers or third parties relating to scoring, rankings, or awards.

6. Fees, Subscriptions and Payments

Some parts of the Service may be provided free of charge, while others may require payment of fees, subscriptions, event passes, or other charges (“Paid Services”).

  • Prices, billing cycles and available plans will be displayed within the Service or communicated separately.
  • You authorize us and our payment providers to charge your selected payment method for all applicable fees.
  • Unless otherwise specified, subscriptions renew automatically at the end of each billing cycle until cancelled.
  • You are responsible for any taxes or duties associated with your purchase, where applicable.

Any specific refund, cancellation and upgrade/downgrade policies will be described in the Service or in separate commercial terms. Where such terms exist, they form part of these Terms by reference.

7. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Infringe the rights of others, including privacy, publicity, or intellectual property rights.
  • Upload, share or transmit content that is unlawful, defamatory, abusive, harassing, obscene or otherwise objectionable.
  • Attempt to gain unauthorized access to the Service, other accounts or computer systems.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Circumvent or attempt to circumvent any usage or security limits of the Service.
  • Reverse engineer, decompile or attempt to derive source code from the Service, except where allowed by law.

We may investigate and take appropriate legal or technical action against violations, including suspending or terminating your access to the Service.

8. Intellectual Property

8.1 Our Rights

The Service, including all software, code, designs, logos, trademarks, text, graphics, and other content created by or for us (“SurfPan Content”) is owned by or licensed to us and is protected by intellectual property laws. Except as expressly permitted in these Terms, you may not reproduce, modify, distribute, or create derivative works based on any SurfPan Content.

8.2 Your Content

“User Content” means any data, text, images, scores, competition configurations or other materials that you or your authorized users submit to the Service. You retain ownership of your User Content. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, reproduce, and process such User Content as reasonably necessary to provide, operate, improve, and support the Service.

You represent and warrant that you have all rights necessary to submit User Content and that our use in accordance with these Terms will not infringe the rights of any third party.

9. Privacy and Data Protection

Our handling of personal data is described in our Privacy Policy, which forms part of these Terms. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

Organizers are data controllers of participant and judge data they upload or collect through the Service. Organizers are responsible for:

  • Providing legally adequate privacy notices to participants and judges.
  • Obtaining any necessary consents or authorizations.
  • Complying with applicable data protection and privacy laws.

10. Third-Party Services

The Service may integrate with third-party services (for example, payment gateways, analytics tools, cloud hosting or communication platforms). These third-party services are governed by their own terms and privacy policies. We are not responsible for the content, availability, or operation of third-party services, and your use of them is at your own risk.

11. Service Availability and Maintenance

We aim to keep the Service available and functioning reliably, but we cannot guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to:

  • Planned maintenance and updates.
  • Unplanned outages or technical issues.
  • Events beyond our reasonable control (force majeure).

We may restrict or suspend access to the Service or specific features when necessary for maintenance, security, or operational reasons.

12. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided on an “as-is” and “as-available” basis, without warranties of any kind, whether express, implied or statutory, including but not limited to any warranties of merchantability, fitness for a particular purpose, title or non-infringement.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure or error-free;
  • Scores or results generated by the Service will be accurate or complete;
  • Any defects or errors will be corrected.

13. Limitation of Liability

To the maximum extent permitted by law, in no event shall we be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenues, data, goodwill or other intangible losses, arising out of or related to:

  • Your use of or inability to use the Service;
  • Any conduct or content of any user or third party;
  • Any content obtained from the Service;
  • Unauthorized access, use or alteration of your transmissions or content.

Our total liability for any claim arising out of or relating to the Service or these Terms shall not exceed the amounts you have paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim, or, if you have not paid any amounts, one hundred (100) euros.

14. Indemnification

You agree to indemnify, defend and hold harmless us and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with:

  • Your access to or use of the Service;
  • Your User Content;
  • Your violation of these Terms or any applicable law;
  • Any dispute between you (or your organization) and any participant, judge, spectator or third party.

15. Changes to the Service or Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. If changes are material, we may provide additional notice (for example, by email or in-app notification).

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.

16. Termination

We may suspend or terminate your access to the Service, in whole or in part, at any time, with or without cause or notice, including if we reasonably believe that:

  • You have violated these Terms;
  • Your use poses a security, legal or operational risk;
  • We are required to do so by law.

You may stop using the Service at any time. Certain provisions of these Terms will survive termination, including but not limited to sections relating to intellectual property, disclaimers, limitation of liability, indemnification and governing law.

17. Governing Law and Dispute Resolution

Unless a different jurisdiction is required by mandatory law, these Terms shall be governed by and construed in accordance with the laws of the Republic of Lithuania, without regard to its conflict of laws rules.

You agree that any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of Lithuania, unless applicable consumer protection laws provide you with additional rights to bring claims in another jurisdiction.

18. Miscellaneous

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets, or by operation of law.
